I like the part where the author says there are no failures in Hollywood for writers, but they just give up. This is a great resource book that has the "whose who" of places a screen writer can get recognition. It isn't an instructional book on how to write screenplays, but where to promote one's script once it is completed and ready to sell or compete in a screenplay contest. The author also tells what kind of scripts make it to the box office and what's the kind of audience that producers want to see the scripts attract for a writer needs to know what kind of scripts sell and what doesn't. Sports and Entertainment Marketing ReviewI was in Ken Kaser's marketing class for two years and i can honestly say with utmost certainty that Mr. Kaser's sports marketing book is the greatest, most compelling story of human drama and intrigue that i have ever read. It is a poignant and touching journey into the human psyche and inded the very nature of man. Through his stunning portrayal of the book's main character (a Jewish man named Trey), Kaser delves into the relms of intelectual enlightenment and human sexuality. While many subjects are explored through the main character's search for the meaning of life, he ultimately confronts the eternal questions of existence such as "Why am i here?", and "Why is Tenney such a bastard?". This book is a life changing epic full of all the things that make great literature great. Ken Kaser has given the world a gift it will appreciate forever and he will go down in history as the greatest writer in the English language. Media Promotion & Marketing for Broadcasting, Cable & the Internet, Fifth Edition ReviewThis book is a typical college textbook. A lot of definitions... a lot of fairly rudimentary information.
It's a good book for people who want to learn basic information about media marketing, but it goes into little to no depth about most aspects of the field.
I also don't get the sense that the authors -- college professors-- have much of a sense of the industry as it is today. Other than a mention of sniping and on-air bugs (which debuted several years ago), the book seems a little out of touch.
Therefore, I wouldn't recommend it to anyone currently working in media marketing, because you'll learn very little new knowledge.

Universal Monsters: Cavalcade of Horror ReviewThe Universal Monsters have been near and dear to my heart ever since I was a kid. Over the years I've watched, and continued to watch all of them from the very early classics, to the later, campy, 1940's films like House of Frankenstein and The Mummy's Ghost. Dark Horse pay homage to four of these classics in Cavalcade of Horror, presenting faithful comic book adaptations of the films with fantastic artwork.
First up is "The Mummy" with script by Dan Jolley and Art by Tony Harris. For years I found the original Mummy film disappointing because the mummy himself only appeared onscreen for a few brief seconds while he was front and center during the four sequels. But overtime I've come to appreciate the sinister performance of Boris Karloff as the reincarnated Imhotep in his guise as the wizened Ardeth Bey and his quest to reunite with his beloved Anhksenamun. Tony Harris did a masterful job of capturing those first few moments where the mummy in the sarcophagus comes to life and shambles off.
Next comes the adaptation of Frankenstein with story and art by Den Beauvais. Beuvais captures a remarkable likeness of Colin Clive as Dr. Frankenstein, Dwight Frye as his assistant Fritz, Mae Clark as Elizabeth, and, of course, Karloff as the monster. Beauvais gets extra points for including the line "In the name of God, now I know what it feels like to be God!" that was screamed by Dr. Frankenstein when the monster was brought to life. That line had been excises from the film for decades until just the recent DVD releases that restored the scene and "blasphemous" phrase. What really stands out though is the emotion that Beauvais captures in the monster...his innocence and joy in playing the flower game with the doomed little girl Maria, and his confusion when he found she did not float like the flowers. This story is wonderfully done.
Dracula gets its treatment care of Dan Vado with art by Jonathan D. Smith. Like the Frankenstein adaptation, this story is painted and is the most moody story in the collection, beginning with Renfield's trip to Dracula's castle where he is greeted by Dracula on the misty, cobweb covered stairs. While Dracula has long been accused of being too "stagey" it still has the best atmosphere of any of the original Universal Horrors and Smith has gone to great lengths to capture that atmosphere as well as an uncanny likeness of Bela Lugosi. It's clear that he studied the film and Lugosi's expressions very well.
Finally, the book concludes with The Creature from the Black Lagoon with script by Steve Moncuse and art by Arthur Adams and Terry Austin. The bright, colorful adaptation of this story stands in direct contrast to the darker-toned first three stories and is the most `comic-looking' story in the book. In a recent interview, Adams discussed how he's been a fan of the Creature for decades. While he doesn't try to capture the true likenesses of the characters, his version of Kay Lawrence, the object of the creature's desire, is still sexy in that white, one piece bathing suit.
Dark Horse has taken great care to stay true to the characters with these stories and no fan of Universal Monsters will be disappointed. While I would have preferred to see the Wolfman or the Invisible Man over the Creature from the Black Lagoon, this is still a triumphant collection of story and art.

Frankenstein: Penetrating the Secrets of Nature ReviewThis book serves as an excellent introduction to the traveling exhibit by the same name organized by the History of Medicine Division of the National Library of Medicine. It provides the reader with a look at Mary Shelley, the times in which she was raised, and the influences that contributed to her writing the original Frankenstein book. There are both color and black and white illustrations which afford the reader a better understanding of this period of time and the context in which the book was written and published. The second section of the book looks at the Frankenstein myth in popular culture and his transformation from an articulate, self-educated being to a grunting brute capable of cruelty without remorse. The 1931 film version starring Boris Karloff is a typical example of this as well as the toys, games, breakfast cereal, coloring books, etc. which came later. The final section of the book addresses the present day concerns which have evolved from this book such as cloning and xenografting (the use of animal parts for tranplantation). The Munsters: A Trip Down Mockingbird Lane ReviewI thoroughly enjoyed this lavishly illustrated book about everybody's favorite family of ghouls. Author Steve Cox was able to touch base with each of the cast members and many of the behind-the-scenes folks who worked on the show (and the movies), and he weaves the many perspectives into a cohesive and delightful look at the people who made the Munsters what it was (and still is). What becomes clear to me is that although there was some friction and conflict on the set (I leave the details to the devoted reader), these people were professionals who knew how to do their jobs and did them better than anyone else could. Subsequent re-incarnations of the family of 1313 Mockingbird Lane have proved that such show-business lightning doesn't strike twice. I gained great respect for Fred Gwynne in particular, who suffered physically and emotionally during the show...a brilliant performer and a great human being! And Al Lewis-though it's somewhat disturbing to think that I am now older than Mister Lewis was when he portrayed Grandpa, I am dazzled by what he brought to the role. Not content with traipsing out the old Lugosi "I want to suck your blood...blah!" stuff, Mr. Lewis created a unique and loveable character from the ground up. Although he may not have been given carte blanche, he certainly took it and ran with it. Butch Patrick, Yvonne DeCarlo and Pat Priest all knew what would work and surprised you with their brilliant work on the show. Hollywood Economics: How Extreme Uncertainty Shapes the Film Industry (Routledge Studies in Contemporary Political Economy) ReviewDe Vany presents a profound and imaginative treatment of the economics of the movie business, one that has implications, not only for similar businesses such as publishing and music, but for our understanding of the dynamics of culture. When Richard Dawkins coined the term "meme" he unwittingly paved the way for tons and tons of sexy but shallow commentary on human culture. Though that is not what he set out to do - "meme" never shows up in the book - De Vany has given mathematical form to the behavior of movie memes and has demonstrated that it is the people who are in change, not the memes.
In the words of screen writer William Goldman, "nobody knows anything" about what happens to movies once they are released to the theatres. Most movies don't even break even, much less make a profit - not in theatrical release, which is what De Vany investigates. [These days, movies make money on DVDs and TV, but that's another story, told by Jay Epstein.] That's no way to run a business, but the problems are inherent in the nature of movies as a business venture. The deep and ineradicable condition of the business is that there is no reliable way to find out whether or not your movie has a market other than putting it on screens across the country and seeing if people come to watch.
Does having "bankable" names on the marquee guarantee that the movie will make bank? No. Does opening big on thousands of screens with PR from here to the moon guarantee that the movie will make bank? No. Does a small opening mean the film is doomed? No. Hence Goldman's remark.
But all is not chaos. Or rather it is, but chaos of the mathematical kind. De Vany shows that about 3 or 4 weeks into circulation movie dynamics (that is, the dynamics of people coming to theatres to watch a movie) hit a bifurcation. Most movies enter a trajectory that leads to diminishing attendance and no profits. But a few enter a trajectory that leads to continuing attendance and, eventually, a profit. Among these, a very few become block busters.
And those few come to dominate the statistics of movie economics. From the point of view of statistics based on the normal distribution those few are movies outliers and should be discounted. De Vany develops a statistical framework - he calls it the stable Paretian model - that gives proper attention to those block busters. The model is stable in the sense that it exhibits the same structure at all scales.

De Vany devotes particular attention to the structure of the movie business. During its glory years the industry was organized by the studio system. The studios owned both the means of production and the means of distribution. Stars, directors, writers, and craftspeople, all were on staff at the studios. When it came time to release films, the studio's distribution system went to work and the films went out to theaters owned by the studios and to independent theaters with long-term booking arrangement. The system worked well.
But in the 1950s an anti-trust action was brought against the studios and they were ordered to divest themselves of their theaters and stop the cozy booking arrangements. The result of that was that was that they lost the stars, directors, writers, and producers - who became independent contractors - and the costs of production went up. And those increased costs were passed on to the movie-goer.
De Vany argues, convincingly, that the studios were not a cartel that drove up prices for their own benefit. Rather, their arrangements, their ownership of theaters, helped them cope with the extreme uncertainty of the business. They had just enough direct control over exhibition practices to stabilize their income so that they could afford to keep the talent on staff. Once that stability was taken from them, they had to let the talent go. And that, in turn, meant that, each time a film was to be made, someone had to go out into the marketplace and put the team together, thus incurring transaction costs that didn't exist in the studio system.

An excellent book. Note that it's thick with mathmatics. But it also has lots of charts. You can read those even if you can't make sense of the equations.

Write to TV: Out of Your Head and onto the Screen ReviewThis book gives you what you need in order to make it in the TV world and it's a great, easy read. I kept wanting to turn the page, just like a TV script, to get to the next section. I've read many books about writing scripts, but this one is going on the reference shelf, right next to my copy of The Elements of Style. It's that special.
What is so perfect about this book, is not only is the information well organized, but it's from someone who has been there. She worked hard to break into the TV industry and her journey resembles the one I am currently going through. It's nice to know that I'm not alone and that someone from the East Coast, with no prior contacts, can make it as a TV writer. I always trust people who actually made it over "Gurus" who teach, but can't do.

The Last Mogul: Lew Wasserman, MCA, and the Hidden History of Hollywood ReviewMy library is filled with books about the inner workings of the entertainment industry, but none of them have even hinted at the massive power and influence of MCA, Dr. Jules Stein and Lew Wasserman. For over thirty years they controlled what Americans were entertained by. As agents, they handled the vast majority of important actors, musician, singers and writers. And you couldn't hire an MCA talent without agreeing to hire others. In addition, they had insider deals with the unions that no other talent agency or television production company enjoyed. In addition, MCA invented the dubious practice of setting up production companies for entertainers so that they could avoid paying taxes. Of course later, when the star's career started to fade, that same production company became an ever-hungry money pit. I don't think it is possible to truly understand why entertainment is what it is in the twentieth century without reading this book. Despite being published by a major house and receiving rave reviews, you are unlikely to see this author on your local talk shows or to find his book in any of the major chain stores, because so many still fear the subject of this book. Clearance & Copyright: Everything You Need to Know for Film and Television ReviewThis is an excellent resource book on legal issues involving clearance and copyright issues affecting the film industry. Numerous sample contracts are presented within this book.
Readers learn a copyright automatically exists to any original book, play, song, photograph, etc. There is no registration required.
It is a violation of the copyright law to make even one copy of a movie.
A copyright lasts 70 years after the death of the author. If a work was written by a corporation, employee or hired employee as a condition of employment, the copyright lasts the lesser of 1.) 120 years from when if was created or 2.) 95 years after it was published.
A derivative work must secure permission from the copyright owner in order to produce an alteration of an original work.
A public performance of copyrighted material, even if performed for free, must request permission from the owner of the owner of the copyright.
Ideas can not be copyrighted. Copyright protects something in a tangible form. Thus, the more written, the more it is protected is someone steals it.
An implied contract bonds an agreement between parties even though the terms have not been settled.
An express contract is an agreement between parties of specific terms, either in writing or orally.
A dispute where a court agrees a story concept was stolen requires both parties to be industry professionals. A studio has no obligation to pay a non-writer for a movie concept. The court also has to agree that the stolen concept was specific enough to the concept used in the movie. The courts in most states will require the concept must be a novel one. Payment for the concept requires showing the author was denied the ability to make money for it in order for it to be a contract dispute rather than a copyright dispute.
A producer who pitched an idea that a studio makes has an implied contract. Courts have upheld this when the studio than made the film with no payment to the producer who pitched the idea. Such cases are often difficult to prove. The person accusing another of stealing ideas has to show by the preponderance of evidence that the accuser's ideas were sent and received by the defendant, that it was clear the sender expected payment should the idea be used, and the accused knew this and accepted the idea on such payment terms.
Many studios require writers to agree to waive their rights before allowed to pitch ideas. Some studio lawyers avoid making this requirement too overbearing that a court would find it unenforceable.
Writers should keep all writings from a studio mentioning their ideas. This may be useful if a paper trail is every needed. It is helpful to keep a record of all meetings and telephone discussions.
Treatments and scripts should be registered with the Writers Guild (WGA). Mailing a script to oneself and not opening it until a trial may not work as opposing counsel may dispute that the seal can not be proved to have never been altered.
Another may make fair use of another's work depending upon how it is used, depending whether or not it is used for profit, the nature of the work, the degree to which a copyrighted work is used, and how much the use of the work affects its value. Appellate courts have made inconsistent rulings regarding fair use. There are arguments between the need for copyright protections versus the needs of First Amendment expressions.
Court rulings have failed to produce clear definitions of what is or is not fair use of copyrighted materials. Fair use will require that it was necessary to make a point, only enough required to make the point was used, and there is a clear connection between what is used and the point.
A parody can be made of a copyrighted work that criticizes or comments on it so long as it does not diminish the value of the copyrighted work. There is no requirement the parody contain humor. 2 Live Crew's "Pretty Woman" was ruled a parody of Roy Orbison's "Oh, Pretty Woman".
A work whose owner can't be found after a legitimate substantial written search is an orphan work that can be used. If the orphan work's owner later appears, fewer copyrighted protections are afforded the owner. A copyright dispute over a character may depend on whether a character has enough original "character delineation". Also important, to a lesser degree, is the degree to which the "story being told" concerns the character in dispute.
A copyrighted logo that appears on clothing used as costume in a film that uses the clothing in its intended use should not be a trademark violation. Documentaries have less to worry about. A lawsuit was filed by the trademark owner of the Barney costume, but lost as it was a parody, over the commercial use of a Barney-like costume.
The owner of source material which a script is based upon owns "underlying property". The "underlying rights" must be obtained from this owner.
A film company has to own the underlying work in order to do anything with the story that involves a film, including re-releases. A work with a -re-1978 copyrighted story may have seen its film rights to a studio cease when a writer died and those rights were inherited.
Often a studio buys an option of a film which gives the studio the right to decide if it will make the film. No other studio could bid on the film while the option remains in effect. The author advises the option be in writing.
In a joint writing effort, if one person has the right to decide what goes into the script, that person has superintendence over the script. Courts have varied over the degree to which superintendence determines the rights between joint authors.
A person generally does not have a reasonable expectation to privacy when in public. Usually a person can be filmed in a public place. The following, though, may be disallowed to be shown if an affirmative misrepresentation was made in the filming.
fictional film should obtain a location agreement for all locations used. Government permits may be necessary for public locations. The author advises making sure the permission is obtained from the right sources. A building owner may not have the right to grant permission for filming inside a tenant's space. A tenant may not have the right to allow cable for filming brought into a building.
Permission may be required to film a decorate art piece. Different court rulings have been reached on this issue. Issues to consider are whether a short focuses on the original art piece, if it is recognizable, and if it is a focal point rather than set dressing.
A prop created for a film should be an original piece. Using a knock-off protected by a copyright still can violate the copyright. A sculptor sued Warner Brothers seeking an injunction to prevent distribution of a movie using a similar sculpture. Warner Brothers settled the suit.
A movie title has to be cleared. Movie titles do not have copyrights. They can be a product protected by trademark. Some movie titles have trademark status. The Motion Picture Association of America registers titles.
A title should not indicate an endorsement from anyone when no endorsement exists.
Errors and omissions insurance protects a film against accidental infringement of a copyright, trademark, person's privacy, etc. Media/Professional and Chubb offers the bulk of this type of insurance.
A final film, called a locked film, should be registered with the Library of Congress.
A copyright infringement can occur if too many specific details of another film are used in a film. A court prevented the release of the movie "Great White" for being too similar to "Jaws."

The New Biographical Dictionary of Film: Fifth Edition, Completely Updated and Expanded ReviewIf you're looking for a standard reference work, look elsewhere (Katz is probably your best bet). That said, this is one of the finest books I've discovered in years. You can read it from cover to cover and never get bored, which is probably impossible to say about any other reference book.
David Thomson is absolutely brilliant. I disagree with about half of what he writes here, but even when I disagree I respect his opinions and greatly admire the way in which he articulates them. Very often in these entries you will find that unexpected beauty and strangeness that are the hallmarks of all great literature and all great art in general. Some of the passages are heartstopping. Here's Thomson on Jean Vigo:
"L'Atalante is about a more profound attitude to love than Gaumont understood. It is love without spoken explanation, unaffected by sentimental songs; but love as a mysterious, passionate affinity between inarticulate human animals."
Have you ever heard a more haunting, uncanny definition of love than this one? I haven't. After reading these words for the first time, I sat there like a fool in shock for five or six minutes, ruminating on their simple profundity.
Thomson is also not afraid to be nasty, which is refreshing in this age of mindless, frothy hype being spewed in all directions on just about everyone. Here he is on Roberto Benigni:
"Then came the thing called La Vite E Bella. As a matter of fact, I often echo that sentiment myself, but if there is anything likely to mar the bella-ness, it is not so much Hitlerism (I am against it), which is fairly obvious, as Benigni-ism, which walks away with high praise, box office, and Oscars. I despise Life Is Beautiful, especially its warmth, sincerity, and feeling, all of which I belive grow out of stupidity. Few events so surely signaled the decline of the motion picture as the glory piled on that odious and misguided fable."
Sometimes that nastiness reaches the heights of pure poetry. Here is Thomson on Richard Gere:
"There are times when Richard Gere has the warm affect of a wind tunnel at dawn, waiting for work, all sheen, inner curve, and posed emptiness. And those are not his worst times."
Lest you think that Thomson is merely a fusty old curmudgeon, let me emphasize that in many other places (through most of the book, in fact), he displays a humanity and generosity of spirit that are nothing short of exemplary.
This book is not so much a reference on film as a meditation on life and everything in it. In these past hundred years movies have covered exactly that kind of encyclopedic range, both in their subject matter and in the lives of their makers. Thomson uses the world of cinema as a vehicle with which to explore the magnificent enigma of life and existence, and somehow manages to pack more of that life into its 963 pages than practically any other book of any genre.
